Regional and International Human Rights Systems have been used to advance and protect people whose rights are violated on the basis of Sexual Orientation, Gender Identity and Expression (SOGIE). While there have been successes in the African Human Rights System including the adoption of Resolution 275, the backlash experienced in 2015 when the African Union’s executive council demanded the withdrawal of a lesbians’ organisation, CAL, observer status stagnated advocacy at the ACHPR. How have international and other regional mechanisms engaged with SOGIE? What are the key lessons, if any, when seeking to reinvigorate SOGIE advocacy? If litigation were to be the next frontier what are the key considerations and potential strategies for the first cases?
