Introduction to the African System of Protection of Human Rights

Objectives: The session aims at providing basic information regarding the African system of protection of human rights, its relationship with the African Union organs, its most important instruments and bodies. At the end of the session participants are expected to better understand the general framework for regional advocacy, the content of regional instruments, and the basic elements of the complex relationship and tensions between the human rights and the political systems.

Audience: The session is particularly indicated for human rights defenders with limited or no previous knowledge of the system, such as individuals who are interested in working in the system and/or are planning on attending the session of the African Commission on Human and Peoples’ Rights for the first time.
Pre-requisite: Pre-registration for this session is required. The reading of the African Charter on Human and Peoples’ Rights (http://www.achpr.org/files/instruments/achpr/banjul_charter.pdf) is recommended.
 
Methodology: The session will consist in an interactive presentation, with support of power point slides. Participants are strongly invited to interact with the facilitators.

Duration: 120 minutes
Outline:
  • Basic Documents: Constitutive Act of the African Union, African Charter on Human and Peoples’ Rights, Maputo Protocol, Decision 1015 AU Executive Council
  • Structure of the African Union
  • Relationship between the political organs and the system of protection of human rights
  • The African Charter: its content and the limits in the exercise of rights
  • The Maputo protocol, the African Charter of the Rights & Wellbeing of the Child
  • The African Commission on Human and Peoples’ Rights and its mandate
  • The Commissioners and their role
  • The double nature of the African system: the African Commission and the African Court
  • The communication system (rudimentary notions, more advanced session is available for individuals interested in litigation)
